The use of the website of Dankal, Tevel Metro (hereinafter: “the Website”) and of the contents presented therein is subject to the terms of use defined and detailed in these Terms of Use (hereinafter: “Regulations”).
The Regulations regulate the relationship between Dankal, Tevel Metro Ltd. (hereinafter: “Tevel”) and any person or other legal entity who browses or uses the Website and/or makes use of the information contained therein (hereinafter: “the User”).
Dankal, Tevel Metro may, at its reasonable discretion and at any time, change and/or update the Regulations without prior notice. A change in the Regulations will enter into force from the moment it is published on the Website.
Intellectual Property Rights
All intellectual property rights, including copyrights, models, methods and trade secrets, registered or otherwise, as part of the Website, the data and/or information appearing on the Website, including (without prejudice): content, services offered therein, design, and in any software, application, computer code, graphic file, Light Rail logo, text and any other material contained in the Website, either in the external interface, in the source code or in the target code, belong exclusively to Dankal, Tevel Metro or to third parties, as the case may be, and are protected by the copyright laws of the State of Israel, international treaties and copyright laws of other countries.
It is prohibited to copy, reproduce, distribute, sell, market, modify, publish, transmit, display, perform, issue a license for, create derivative works or reverse engineer, in whole or in part, temporarily or permanently, in any form, any information from the Website, including trademarks (registered or otherwise), images and texts, etc. without the prior written consent of Dankal, Tevel Metro. Also, the Website may not be used in a manner that constitutes or may constitute a violation of or injury to the intellectual property of Dankal, Tevel Metro without its express written consent for this.
Without prejudice to the aforesaid, the name Dankal, Tevel Metro as well as the domain name of the Website, the trademarks (registered or otherwise) are the property of Dankal, Tevel Metro only. They may not be used without the prior written consent of Dankal, Tevel Metro. Also, they may not be used in any way except for personal and non-commercial needs, provided that the use is made in accordance with the law.
Website Content and Integrity
Tevel Metro and/or anyone on its behalf will not bear any responsibility in relation to the contents of the Website; Their content, accuracy, reliability of the contents and their effect on the users, including on the computers and end devices of the users and any damage, inconvenience, aggravation that will be caused to the user, his property or a third party, whether directly and/or indirectly, due to the use of the contents on this Website.
Dankal, Tevel Metro does everything in its power to ensure that the information presented on the Website is as complete and accurate as possible, but it should be clarified that inaccuracies or errors may appear in it, in good faith, including, but not limited to, changes in dates and/or non-compliance with schedules and/or line cancellation.
Also, and without prejudice to the generality of the aforesaid, the information displayed on the ticketing pages is according to the guidelines of the Ministry of Transportation.
In any case, Dankal, Tevel Metro and/or anyone on its behalf (including the operating contractor) will not bear any responsibility arising from or related to such information or for damage and/or expense caused due to acts or omissions as stated above.
The availability of the information and services offered within the Website (including links to ticket purchasing and/or payment websites) is not constant, and sometimes even subject to agreements between Dankal, Tevel Metro and/or someone on its behalf and third parties, therefore Dankal, Tevel Metro may, at its sole discretion, to update and/or cancel and/or remove an application, service or specific content from the Website, from time to time, immediately and without prior notice and subject to applicable law, and the user shall not have any claim and/or demand in connection therewith.
It is possible that as part of the use of the Website, Dankal, Tevel Metro may provide links and references to various websites and Internet pages, operated by third parties (hereinafter: “Linked Websites”) where the User can, among other things, make payments and/or receive or purchase products and/ or various services, including purchasing tickets and/or purchasing or loading Rav-Kav cards.
Browsing these websites and pages, as well as any other action performed by the User in connection therewith, are the sole responsibility of the User and the owners of the linked websites, and the User shall not have and hereby waives in advance any claim and/or demand for direct and/or indirect loss, injury or damage against Dankal , Tevel Metro and/or anyone on its behalf arising from reliance and/or use of content and/or information provided on these websites and/or as a result of the unavailability of the Linked Websites for any reason.
Without prejudice to the generality of the aforesaid, it is possible that the Linked Websites’ websites and pages will require the User to register, provide various details, etc. It is agreed that Dankal, Tevel Metro has no knowledge, control or responsibility regarding what happens on these websites. Providing details and registering on these websites is not subject to the privacy policy of Tevel Metro, but rather to the privacy policy of said Linked Websites and the provisions of any law. The privacy policy of the User’s use of the Website and/or his communication with Tevel Metro within the framework of the Website constitute consent on the part of the User that information about the User provided by him to Tevel Metro, as well as any other information that is generated based on this information (“the Information”), will be kept and managed by Dankal, Tevel Metro and will be used for the purpose of providing the services on the Website (including online payment of increased fares); Sending marketing mail (subject to applicable law); Supporting and handling requests and complaints, improving the services provided through the Website, and any other action required to comply with the requirements of any law.
The User’s Duties
The use of the Website is subject to the following conditions
A. The right to use the information, contents and services on the Website is intended for the User’s personal and private use only. It is prohibited to make any commercial use of any of the above for any profit purposes, and the User may not allow such information, contents to be used by any third parties, with or without consideration.
B. The user undertakes to use the Website, as well as the information, contents and services distributed or included therein, only according to the law and in accordance with the provisions of these Regulations.
C. The User undertakes not to link to the Website and/or the Linked Websites and/or use them and/or the information, contents and services included therein for the purpose of uploading, downloading, distributing, publishing or transmitting: (1) information or other material in a manner that violates any rights, including intellectual property rights, privacy protection rights and/or any other proprietary right; (2) Information or other material that is prohibited for publication or use, due to its constituting a threat, injury, insult, libel, defamation, racism or inappropriate content; (3) Information or other material that includes a virus or other software that may damage the computer systems of Dankal, Tevel Metro and/or any third parties or in a manner that may limit or prevent others from using the Website; or (4) Information or other material that includes advertising of any kind without the prior written permission of Dankal, Tevel Metro.
D. The user undertakes not to change and/or interfere in any way with the source code of the Website and/or the Linked Websites and/or the information and/or content contained therein and not to upload any software and/or applications that may harm or cause damage to the Website and/or Dankal Tavel Metro and/or to any other third parties.
E. The User agrees that, without prejudice to any other right available to Dankal, Tevel Metro, in cases where Dankal, Tevel Metro is concerned that the User’s use of the Website does not comply with the terms of use and/or any law, it may terminate the User’s activity with the Website’s services, including by blocking his IP number, tracking the User’s use of the Website, transferring the User’s behavior patterns to the relevant authorities and/or to third parties who will prove, to the satisfaction of Dankal, Tevel Metro, the injury caused to them by the User’s infringing activity, as well as any other action that Dankal, Tevel Metro will deem appropriate to protect its property and/or your rights and/or the rights of third parties.
Advertising Content
All advertising content, information and tips published on the Website and/or on its Linked Websites are the sole responsibility of the advertisers. The Website content should not be construed as a recommendation or opinion of any kind. The User is solely responsible for the use of the advertising content.
Dankal, Tevel Metro may, but is not obligated, to send users publications, updates, innovations, etc. (collectively: “Marketing Mail”) from time to time, among other things via e-mail or SMS messages, subject to obtaining the recipient’s consent in accordance with the provisions of Article 30A of the Telecommunications Law (Bezeq and Broadcasting), 5742-1982.
The User may at any time opt out of receiving Marketing Mail from Dankal, Tevel Metro, according to the User’s choice.
Limiting the Use of the Website
Without prejudice to the aforementioned, Dankal, Tevel Metro may prevent a User from making any use of the Website in any of the following cases:
A. The User has committed an illegal act and/or violated the provisions of the law;
B. the User has violated any of the terms of these Regulations;
C. C. The User has committed an act or omission that harms Dankal, Tevel Metro and/or someone on its behalf and/or any third party, including other users of the Website and/or the passengers of the Light Rail and/or the proper operation of the Website.
COOKIES
The site uses “cookies” and this, among other things, for the purpose of the ongoing and proper operation of the site, collecting statistical data about the use of the site, verifying details, providing personalized content and information security needs.
“Cookies” are information elements stored on the user’s hard drive that include information about the user. Modern browsers include an option to avoid receiving cookies. You can check the help file of the browser you are using to examine the possibility of removing the cookie option. You are of course entitled to refuse to use cookies – however, as long as you do so, you will indeed be entitled to continue using the site, but it is possible that parts or features of the site will be limited for you.
Miscellaneous
A. Dankal, Tevel Metro and/or anyone on its behalf will not be responsible and will not bear any indirect, consequential or special damage caused to the User and/or any third party as a result of using the Website and/or relying on the information and/or data appearing therein or purchasing of a product or service on the Linked Websites, including loss of income and/or loss of profit for any reason.
B. B. Any disputes, claims and lawsuits in connection with the Website including, but not limited to, the content and services/products found or offered therein, will be discussed according to the laws of the State of Israel, without their choice of law rules. The exclusive place of jurisdiction for any matter related to these Regulations and the use of the Website is the competent courts in the city of Tel Aviv-Yafo, and the parties expressly deny the jurisdiction of any other court in this matter.
C. Should any of the provisions of these Regulations be determined illegal and/or invalid by the court, it would not invalidate the other provisions of these Regulations and/or the other parts of that provision that were canceled and/or reduced by the court, which were not canceled or reduced.
D. Any delay by Dankal, Tevel Metro in exercising a right to which it is entitled or its non-compliance with a right to which it is entitled according to these Regulations or by law, is before the letter of the law only and shall not be used or construed as a waiver of such right on the part of Dankal, Tevel Metro.
